Acumen Re Management Corp. v. General Security National Ins. Co., 12-5081-cv
In this breach of contract suit, the district court entered partial summary judgment for defendant, ruling that four of the five breach-of-contract theories were baseless and that no more than nominal damages were available. Judgment was then certified under the Federal Rule of Civil Procedure 54(b). The appeal is dismissed, where the district court's certification under Rule 54(b) was improper in that its partial judgment did not address separate claims for relief. The present court therefore lacks jurisdiction to entertain the appeal.
