US v. Adams, 13-146-cr

In this appeal, defendant alleges that his entry of a guilty plea was influenced by his heart condition and the medication he was taking. Conviction and sentence of defendant following a plea agreement is affirmed, where: 1) defendant has made no showing of plain error in the Rule 11 proceedings as he has not established a reasonable probability that, but for the error of the district court not inquiring about the effects of the heart condition, he would not have entered the plea; 2) the waiver contained in the plea agreement forecloses any challenge to the sentence; and 3) even if the waiver were unenforceable, defendant’s sentence falls within the range of permissible decisions and does not violate the Eighth Amendment.
