US v. Mergen, 12-2873

Conviction of defendant-informant for a Travel Act offense as well as various criminal acts is: 1) vacated with respect to the Travel Act conviction because the district court erred when it excluded, on hearsay and authentication grounds, a recording in which an FBI agent assured defendant that he had done nothing wrong in connection with the underlying arson; and 2) reversed with respect to all of defendant's remaining convictions because the wording of the informant cooperation agreement did not toll the statute of limitations, that since expired.
