United States Second Circuit

Jackson v. Conway, 11-922

Judgment granting petitioner habeas relief is: 1) affirmed in part, where the petitioner's Miranda claim was an "unreasonable application" of clearly established Supreme Court precedent; and 2) reversed in part, where the the District Court failed to afford the state court's rejection of petitioner's prosecutorial misconduct and ineffective assistance of counsel claims the proper deference it was entitled to under the Antiterrorism and Effective Death Penalty Act.
