Acharya v. Holder, 11-4632

A petition for review of a decision of the Board of Immigration Appeals dismissing an appeal from an oral decision of the Immigration Judge, which denied petitioner petitioner's application for asylum, withholding of removal, and for protection pursuant to the Convention Against Torture, is granted, where: 1) the Immigration Judge stated incorrectly that petitioner had failed to establish that political opinion was "the central reason" for his persecution, rather than only "at least one central reason"; and thus, 2) the Immigration Judge committed error in requiring petitioner to meet an incorrect and overly stringent burden of proof.
