In an adversary proceeding in the bankruptcy court, where plaintiff claims that debtor's deficient record-keeping, which led to sanctions in a prior state action where plaintiff had sought fees owed under a referral agreement from the debtor and his law partner, also barred the debtor's discharge, the bankruptcy court's grant of summary judgment to the debtor is affirmed, where 11 U.S.C. section 727(a)(3) does not bar discharge under the circumstances presented.
