United States Second Circuit

US v. McDonald, 12-2056

Defendant's convictions of securities fraud, wire fraud, and mail fraud, are affirmed, where: 1) a jury poll revealed that the guilty verdict was not unanimous; 2) the district court did not err in its response to the jury poll instructing the jury to continue its deliberations; and 3) defendant was not entitled, in this context, to a further charge counseling jurors to hold fast to their conscientiously held beliefs.
