United States Second Circuit

US v. Kopstein, 13-417

Defendant's conviction of transporting and shipping child pornography to a federal agent posing as a twelve-year‐old girl during an electronic conversation in a chat room is vacated and remanded, where the jury instructions failed to consistently and adequately guide the jury on defendant's only defense of entrapment to the only charge that carried a mandatory minimum sentence.
