Olsen v. Stark Homes, Inc., 13-247
Dismissal of plaintiffs' claims that defendants discriminated against them on the basis of handicap or disability, in violation of the Fair Housing Act and the N.Y. State Human Rights Law, when it rejected plaintiffs' attempt to acquire housing, is vacated and remanded, where: 1) the district court properly declined to grant judgment as a matter of law in favor of plaintiffs on the reasonable accommodation claim; but 2) as to all of plaintiffs' claims, the evidence was sufficient to preclude the granting of judgment in favor of defendants as a matter of law.
