United States Second Circuit
Cook v. National Archives & Records Administration, 13-1228
Summary judgment in favor of defendant in plaintiff's action brought under the Freedom of Information Act, seeking National Archives records relating to requests for archived materials made by or on behalf of former President George W. Bush and former Vice-President Richard B. Cheney, is affirmed, where the records fall within Exemption 6 of the statute because: 1) these requests of the former President and Vice-President at issue here, made for purposes of their private research, perhaps for preparation of memoirs, reveal their preliminary thinking and personal matters; 2) the disclosure of this information would indeed "constitute a clearly unwarranted invasion of personal privacy"; and 3) the former officials' compelling privacy interests outweigh any public interest in disclosure.
