United States Second Circuit
Vermont Right to Life Committee, Inc. v. Sorrell, 12-2904
Summary judgment in favor of defendants, Vermont officials charged with enforcing Vermont elections statutes, in a constitutional challenge to statutory provisions that require identification of the speaker on any "electioneering communication," require reporting certain "mass media activities," and define and require reporting by "political committees" is affirmed, where: 1) the challenged provisions are not vague, do not violate the First Amendment, and are constitutional; and 2) there was no genuine dispute of material fact as to plaintiff VRLC‐Fund for Independent Expenditures' (VLRC-FIPE) organizational separation from plaintiff VRLC‐Political Committee, and therefore Vermont's contribution limits as applied to plaintiff VRLC-FIPE are permitted.
