In an action brought by plaintiffs, who were individual and institutional investors in so-called Madoff feeder funds, against defendants who managed the funds and their outside accountants, an appeal from the district court's judgment approving the settlement of putative class action securities claims against certain defendants over the objections of non‐settling defendants is dismissed, where: 1) the non-settling defendants challenge one provision in the settlement agreement provides that investors who file claims under the settlement submit to the district court's jurisdiction for the sole purpose of participating in the settlement and not for any other purpose; and 2) the non-settling defendants do not have standing to challenge the settlement.
