US v. Ganias, 12-240

Defendant's conviction of tax evasion is vacated and remanded, where: 1) there was no abuse of discretion in the district court's decision not to order a new trial based on a juror posting comments about the trial on his Facebook page and becoming Facebook friends with another juror during the trial; but 2) defendant's Fourth Amendment rights were violated by the unauthorized retention of his personal files.
