Doe v. Cuomo, 12-4288

Summary judgment in favor of defendants New York State Governor and Acting Commissioner of the State of New York Division of Criminal Justice Services in an as-applied constitutional challenge to the enforcement of amendments to the notification and registration requirements of the New York State Sex Offender Registration Act (SORA), is affirmed, where: 1) the amendments post-dated plaintiff's plea of guilty to misdemeanor attempted possession of a sexual performance by a child, for which he was classified as a level-one sex offender required to register under SORA; 2) defendant's constitutional claims are without merit; and 3) application of the amendments to him did not violate his plea agreement.
