Louisiana Wholesale Drug Co. v. Shire LLC, 13-1232

In an action brought by plaintiffs, wholesale dealers in pharmaceutical products, alleging that defendant drug manufacturers violated the Sherman Act by breaching their contracts to supply competing manufacturers with an unbranded version of defendants' widely prescribed patented drug, dismissal of the suit is affirmed, where plaintiff has failed to allege facts that would place this case outside the "long recognized right of a trader or manufacturer engaged in an entirely private business, freely to exercise his own independent discretion as to parties with whom he will deal."
