Stanczyk v. City of New York, 13-1582

The district court's judgment in favor of plaintiff in her 42 U.S.C. section 1983 action alleging excessive force awarding her $55,000 in compensatory damages and $2,000 in punitive damages against each defendant officer, and subsequent order awarding defendants all costs accrued following the date of defendants' Rule 68 Offer and awarding plaintiff pre-Offer attorney's fees and costs, are affirmed, where: 1) with respect to the damages award, plaintiff fails to establish that the challenged conduct caused prejudice; and 2) the district court properly applied Rule 68 and did not abuse its discretion by reducing the reasonable hourly rate of plaintiff's lead counsel.
