Dismissal of an action brought by plaintiff-real estate developer against defendant owners and lessee of the World Trade Center under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) seeking recovery of costs incurred in remediating a nearby building contaminated by the September 11, 2001 attack on the World Trade Center, is affirmed, where the attack constituted an "act of war" for which CERCLA provides an affirmative defense.
