United States Second Circuit

US v. Miles, 13-1158

Defendant's conviction being a felon in possession of a firearm and sentence for to the mandatory minimum term of fifteen years under the Armed Career Criminal Act (ACCA) are affirmed, where the district court did not err in: 1) denying defendant's motion to invoke entrapment by estoppel; and 2) finding that an "innocent possession" defense was unavailable; 3) finding the police had probable cause to arrest and frisk defendant; and in sentencing defendant under the ACCA.
