Widomski v. State University of New York at Orange, 13-1367

Summary judgment in favor of defendant-university on plaintiff's claims of discrimination on the basis of a "perceived disability" and retaliation in violation of Title II of the Americans with Disabilities Act of 1990 (ADA), is affirmed, where: 1) plaintiff failed to raise a genuine dispute of fact as to whether defendant perceived him as being substantially limited in the major life activity of working; and 2) plaintiff failed to raise a genuine dispute of fact as to whether defendant's explanation for bringing disciplinary proceedings against him was pretext for retaliation.
