Psihoyos v. John Wiley & Sons, Inc., 12-4874

In an action alleging copyright infringement based on defendant's publication of textbooks containing plaintiff's photographs, partial summary judgment for defendant as to several of the infringement claims on the basis that plaintiff had failed to register the relevant photographs, and judgment awarding plaintiff statutory damages for three of the remaining photographs, are affirmed, where: 1) plaintiff had not even filed the applications for registration of the relevant works prior to instituting the action claiming infringement of the copyright in these works, as required; 2) the district court acted within its discretion in partially denying plaintiff leave to amend his complaint; and 3) the district court did not abuse its discretion in refusing to alter the jury's award of statutory damages.
