US ex rel. Keshner v. Nursing Personnel Home Care, 13-1688
In two appeals from an award of attorney's fees to plaintiff following a settlement between the parties of a False Claims Act action, plaintiff's motions to dismiss defendant's appeals are: 1) denied as moot in Case No. 13-1688, in view of the pending timely appeal from a partial judgment entered on the same attorney's fee award; and 2) denied in Case No. 14-251, where the fee award, entered before entry of a final judgment or a partial judgment entered pursuant to Rule 54(b) of the Federal Rules of Civil Procedure, did not have to be appealed until entry of an appealable judgment, and thus the appeal was timely.
