Fracasse v. People’s United Bank, 13-266

The district court's judgment dismissing plaintiff's complaint alleging state law claims for unjust enrichment, negligent infliction of emotional distress, wrongful termination in violation of public policy, and breach of the covenant of good faith and fair dealing, for failure to state a claim is vacated and remanded, where: 1) the district court lacked subject matter jurisdiction in this action because the "federal issue" arising in these state law claims is not substantial; and 2) the district court is instructed to remand the case to the Connecticut Superior Court.
