Summary judgment for defendant-employer on plaintiff's claims of discrimination and retaliation in violation of the Americans with Disabilities Act of 1990 (ADA) and analogous state and local anti-discrimination law, as well violations of the Fair Labor Standards Act's overtime pay requirements is: 1) vacated and remanded in part with regard to plaintiff's discrimination claim, where an employee's inability to sit for a prolonged time may constitute a disability under the ADA; but 2) otherwise affirmed.
