Nielsen v. Rabin, 12-4313
The district court's order dismissing a pro se plaintiff's action against defendant-doctor under the Fourteenth Amendment for deliberate indifference to his serious medical needs, and denying leave to amend, is reversed to allow leave to amend, where amendment would not be futile because plaintiff can plausibly allege that defendant acted with a sufficiently culpable state of mind.
