United States Second Circuit
Rosu v. City of New York, 13-243
Dismissal of plaintiff's complaint challenging the New York City Commission on Human Rights' procedures, is affirmed, where: 1) defendants did not have a duty to perform any activity that they allegedly failed to perform, so the district court correctly concluded that not performing such actions was not a violation of the process to which plaintiff was entitled; and 2) the Commission's procedures satisfy due process.
