Kalyanaram v. American Association of University Professors, 12-3630
Dismissal of plaintiff-employee's suit alleging that his union breached its duty of fair representation is affirmed, where: 1) plaintiff-employee's claim against the union accrued when the arbitrator issued his final award, notwithstanding language in the collective bargaining agreement that such awards were subject to challenge in court by either party; and 2) the limitations period was not tolled by plaintiff-employee's state court action to vacate the arbitrator's award.
