Koehl v. Bernstein, 12-3855
The district court's order of sanctions imposed on plaintiff-inmate dismissing his 42 U.S.C. 1983 action with prejudice is affirmed, where: 1) the district court did not abuse its discretion in dismissing the case based on plaintiff's abusive attacks, slurs, and insults directed at the magistrate judge to whom the case was referred; and 2) there was no error in the district court's underlying findings that plaintiff acted in bad faith and that no other sanction would suffice.
