In Re: Grand Jury Subpoena Dated February 2, 2012, 13-403
A contempt order and an order compelling John Doe to comply with a grand jury subpoena are affirmed, where: 1) the subpoena seeks records of Doe's foreign banks accounts, which the Bank Secrecy Act requires United States resident account holders in foreign banks to maintain; 2) the district court did not err in holding that the "required records" exception to the Fifth Amendment privilege against self-incrimination applies; and 3) because Doe cannot lawfully excuse his failure to comply with the subpoena, the district court was within its discretion to impose sanctions for his noncompliance.
