United States Second Circuit

US v. Aguiar, 11-5262

Defendants' convictions on multiple charges related to their participation in a conspiracy to distribute cocaine and heroin are affirmed, where the government's placement of a global positioning system device (GPS) on defendant's vehicles falls within the good‐faith exception set forth in Davis v. United States, 131 S. Ct. 2419 (2011) because at the time of their actions, law enforcement could have reasonably concluded that placing a GPS device on the exterior of defendant's vehicles did not violate the Fourth Amendment.
