New York Progress and Protection PAC v. Walsh, 13-3889
The district court's order denying plaintiff's request for a preliminary injunction to enjoin enforcement of two New York election laws that would prevent plaintiff from receiving more than $150,000 from any individual contributor in any calendar year, is reversed and remanded, where: 1) plaintiff here has a substantial likelihood of success on the merits because after Citizens United, it follows that a donor to an independent expenditure committee such as plaintiff may not be limited in his ability to contribute to such committees; and 2) the remaining factors weigh in favor of granting the injunction.
