Lederman v. N.Y.C. Dept. of Parks & Recreation, 12-4333
Summary judgment for defendants in a First Amendment challenge to regulations governing the sale of expressive matter in New York City parks is affirmed, where the district court did not err in: 1) holding that the vending regulations are valid content-neutral time, place, and manner restrictions; and 2) barring the depositions of Mayor Bloomberg and former Deputy Mayor Skyler, because, to depose a high-ranking government official, a party must demonstrate exceptional circumstances justifying the deposition, which plaintiffs did not demonstrate here.
