Velez v. City of New York, 12-1965
Judgment for defendant officers in action in which plaintiff alleged that defendants were liable for her son's death when he was murdered after the defendant officers searched an apartment based on a confidential tip from him, is affirmed, where: 1) the district court did not err in instructing the jury that New York law required plaintiff, as a prerequisite to liability, to establish a special relationship between defendant officers and her son; and 2) the district court did not err by dismissing plaintiff’s state law negligent training claims against defendant City.
