Washington v. Gonyea, 11-980

Dismissal of plaintiff-prisoner's claim alleging that defendant-state prison officials substantially burdened his right to free exercise of religion in violation of the Religious Land Use and Institutionalized Persons Act of 2000 (RLUIPA) when he was disciplined for giving a Quran to one of defendants, is affirmed, where plaintiff's RLUIPA claim must fail because RLUIPA: 1) does not authorize monetary damages against state officers in their official capacities; and 2) does not create a private right of action against state officers in their individual capacities.
