Blue Ridge Investments, L.L.C. v. Republic of Argentina, 12-4139
The district court's order denying Argentina's motion to dismiss petitioner's petition to confirm an arbitration award is affirmed, where the district court correctly found that Argentina waived its immunity from suit under two exceptions to the Foreign Sovereign Immunities Act: 1) the so-called implied waiver exception, described in 28 U.S.C. section 1605(a)(1); and 2) the so-called arbitral award exception, described in 28 U.S.C. section 1605(a)(6).
