Simon v. City of New York, 11-5386
District court's denial of plaintiff's motion for reconsideration of a previous order and judgment granting defendants' motion for summary judgment on the basis of absolute immunity, is reversed and remanded where the court erred in finding that detaining an individual for two days pursuant to a material witness warrant is a prosecutorial function entitled to absolute immunity.
