US v. Lynch, 12-4222

District court's denial of motion to dismiss the indictment for violation of the Speedy Trial Act is affirmed where: 1) defendant's seventy-day period in which to commence trial under the Speedy Trial Act did not begin until defendant first appeared in court in the district where the indictment was filed; and 2) the district court could grant an "ends-of-justice" exclusion of time under 18 U.S.C. section 3161(h)(7)(A) without the defendant's consent.
