US v. Edelman, 12-2166
Defendant's conviction of three counts of possession with intent to distribute and distribution, and one count of escape are affirmed, where: 1) defendant's placement in a residential reentry facility as a condition of the modification of his supervised release constitutes "custody by virtue of a conviction of any offense" under 18 U.S.C. section 751(a), the statute governing escape; and 2) the district court did not err in denying defendant's motion to suppress evidence.
