US v. Juncal, 10-1800

Defendants' convictions and sentences for conspiracy to commit mail and wire fraud arising out of a scheme to obtain a three billion dollar loan supposedly intended to finance construction of a pipeline across Siberia, is: 1) affirmed in part as to the convictions, where a reasonable jury could find that defendants' misrepresentations were material, regardless of whether the witness, or others like him, should have heeded them or not; and 2) vacated in part and remanded for resentencing, where the district court committed procedural errors in sentencing.
