Judgment for defendant on plaintiffs' claim that defendant violated their First, Fourth, and Fourteenth Amendment rights when he arrested them at a public event during which they were protesting the treatment of circus animals, is: 1) affirmed in part, where defendant was entitled to qualified immunity; 2) affirmed in part, as to the denial of attorney's fees; and 3) vacated in part and remanded, to the limited extent necessary for the district court to clarify whether plaintiffs are entitled to costs as a discovery sanction.
