Porter v. Quarantillo, 13-119
Summary judgment for defendants in action brought by plaintiff for declaratory judgment that he was a United States citizen since birth is affirmed, where: 1) the district court did not abuse its discretion in determining that statements from his mother and several others asserting that she was born in the United States and left after her first birthday were inadmissible hearsay; and 2) because plaintiff submitted no sufficient admissible evidence establishing his mother's age at relocation, the district court correctly determined that plaintiff was not entitled to derivative citizenship.
