Dorchester Financial Securities, Inc. v. Banco BRJ, S.A., 12-770
Dismissal of plaintiff's complaint alleging breach of contract and fraud for lack of personal jurisdiction is vacated and remanded, where: 1) as here, when a district court chooses not to hold an evidentiary hearing, a plaintiff need only make a prima facie showing of personal jurisdiction to survive a motion to dismiss brought under Federal Rule of Civil Procedure 12(b)(2); and 2) plaintiff's allegations in this case were sufficient to make such a prima facie showing.
