United States Second Circuit

US v. Cuti, 11-3756

Defendants' convictions for securities fraud are affirmed, where: 1) the district court did not abuse its discretion in admitting the lay witness testimony as to what the accounting treatment of the transactions at issue would have been absent the fraud; and 2) defendant Tennant's remaining claims are without merit.
