Souratgar v. Lee, 12-5088

The district court did not err in granting father's petition under the Hague Convention on the Civil Aspects of International Child Abduction for repatriation of the child to Singapore, where: 1) the mother had removed her child from Singapore to New York State in violation of a Singapore court order; 2) there was no error in the district court’s determination that mother had failed to meet her burden to establish the Article 13(b) defense that a grave risk of harm would result from repatriation; and 3) the district court did not err in rejecting mother's Article 20 defense, which allows repatriation to be denied when it "would not be permitted by the fundamental principles of the requested State relating to the protection of human rights and fundamental freedoms."
