United States Second Circuit

Stansbury v. Wertman, 12-713

In a 1983 action alleging false arrest and malicious prosecution, the district court's denial of defendant's motion for summary judgment is reversed and remanded, where: 1) in analyzing the evidence its totality rather than in isolation, the evidence provided defendant with probable cause to arrest and prosecute plaintiff; and therefore, 2) defendant is entitled to judgment as a matter of law.
