In re: Bernard L. Madoff Investment Securities, 11-5051

Dismissal of claims brought by trustee, who was appointed pursuant to the Securities Investor Protection Act, on behalf of the debtor, Bernie Madoff and the debtor's customers, asserting that various financial institutions and other defendants aided and abetted Mr. Madoff's fraud, is affirmed, where: 1) the claims were barred by the doctrine of in pari delicto; and 2) the trustee lacked standing to pursue claims on behalf of the customers.
