The district court's denial of petitioner's writ of error coram nobis to vacate his tax evasion conviction on the basis of alleged ineffective assistance of counsel in advice given as to the immigration consequences of petitioner's guilty plea, is affirmed, where the district court did not err in concluding that: 1) the petition is untimely; and 2) defendant failed to demonstrate either deficient performance of counsel or prejudice from the alleged advice.
