Marshall v. Randall, 12-2479

Judgment for plaintiff finding defendant-officers liable for false arrest, malicious prosecution, and violation of plaintiff's right to a fair trial is affirmed, where the district court did not err: 1) in allowing the use of defendants' grand jury testimony for impeachment purposes; 2) declining to instruct the jury that plaintiff's criminal case was dismissed on speedy trial grounds; and 3) excluding from trial evidence that defendant Burbridge stopped plaintiff in part because he recognized plaintiff from a review of NYPD arrest reports.
