United States Second Circuit

Guzzo v. Cristofano, 12-74

In an action under the Hague Convention, alleging that the mother wrongfully removed petitioner's child from Italy and seeking return of child to Italy, the District Court properly denied the petition for return of the child where petitioner: 1) failed to show that the parents agreed to settle in Italy; and 2) did not attempt to show that the child had acclimated there.
