In a copyright infringement action brought by the creator of the comic book character Ghost Rider, the District Court's grant of summary judgment and award of damages to publisher defendant on its counterclaim of infringement, on grounds that plaintiff assigned his rights in a work-for-hire contract, are vacated where: 1) the contract language is ambiguous; and 2) genuine disputes of material fact remain which preclude judgment as a matter of law.
