Motion to reinstate an appeal is denied, where: 1) dismissal was properly based on plaintiff's failure to file a brief in compliance with a scheduling order; 2) plaintiff has demonstrated a persistent indifference to the court's scheduling orders and local rules; and 3) plaintiff was afforded ample time, and considerable choice in selecting dates, in which to file its brief and appendix and given an explicit warning of the consequences of failing to meet the extended deadline.
